HOUSE CONCURRENT RESOLUTION NO. 42

Requesting the Joint Committee on Government and Finance to make
a study of the effect on West Virginia insurance consumers
and insurance agents when an insurer withdraws from
contractual relationships in any segment of the insurance
market in this state.
Whereas, Many insurance consumers seek protection of their
persons and property through insurance contracts executed on
their behalf by duly licensed and appointed insurance agents; and
Whereas, The insurance commissioner has indicated that there
is cause for concern for the rights of consumers and insurance
agents in the event of insurance company withdrawals from any
segment of the West Virginia insurance marker; and
Whereas, Insurance consumers and insurance agents are
interested in defining their rights in the event of insurance
company withdrawals from any segment of the West Virginia
insurance market; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to review, examine and study this issue and make such
recommendations to the Legislature as it determines to be in the
best interests of West Virginia consumers and independentinsurance agents; and, be it
Further Resolved, That the Joint Committee on Government and
Finance report to the regular session of the Legislature, 1997,
on its findings, conclusions and recommendations, together with
drafts of and legislation necessary to effectuate its
recommendations; and, be it
Further Resolved, That the expenses necessary to conduct
this study, to prepare a report and to draft necessary
legislation be paid from legislative appropriations to the Joint
Committee on Government and Finance.
